New US ambassador defends Hicks's detention

You defend Georgie and his band of thugs, when Hicks crimes are laid out and he is charged, As it is no one has been tried and found guilty at Gauntanamo in 4 1/2 years. I thought in any DEMOCRACY a person was innocent until found guilty and your Government has had 4 1/1 years to find this young man guilty what do you want to hold him for the rest of his life without trial.
The new United States ambassador to Australia has defended the treatment of Australian Guantanamo Bay detainee, David Hicks.

After a delay of more than a year, Robert McCallum has taken up his new position in Canberra.
The previous ambassador, Tom Schieffer, is now based in Japan.

At his first media conference in Australia the former lawyer has praised the relationship between the two countries.

But on the ongoing detention of Hicks, who has been at Guantanamo for more than four years, Mr McCallum defends the US position.

"The law of war allows the detention of enemy combatants during the course of hostilities - there is still a war on terror," he said.

Mr McCallum says one option for Hicks is out of the question.

"He will not face the death penalty," he said.

Mr McCallum says while he does not plan to interfere in domestic politics, he will not avoid issues.

"When I am asked a question, unfortunately again I refer to my lawyer background," he said.
"I will bring to it an advocate's zeal."

The US Congress is expected to decide on a new military commission process next month.
Hicks's Australian lawyer, David McLeod, says because the new legislation is still in draft form it is too early for assurances.

He says Hicks's ongoing detention without charges being laid is unacceptable.

"And [it] would not pass the rigorous standards imposed by common article three of the Geneva Conventions which the US Supreme Court has indicated must apply to detainees at Guantanamo," he said.

"So here is yet another round of assurances from the people holding the keys to the jail that all is well, and it's just not acceptable."

The previous military commissions, under which Hicks had been due to stand trial, were ruled unconstitutional by the US Supreme Court.
