Senate May Limit Bush Insurrection Power

WASHINGTON April 25 (UPI) -- The Democratic-controlled Senate Tuesday opposed what it calls a White House power grab.
The Democrats also received support from a key Republican senator. Sen. John Warner, R-Va., Wednesday said he would be open to revising a controversial law that gave the U.S. president more power over states and the National Guard in times of emergency.
On Tuesday, the governor of North Carolina told the Senate Judiciary Committee all U.S. governors oppose the Insurrection Act Rider that was included in the fiscal year 2007 defense authorization bill.
Committee Chairman Sen. Patrick Leahy, D-Vt., said the law, which gives the president the power to take command of the National Guard "in any situation in which he determined" a state government incapable of maintaining public order.
